EXECUTIA AS and EXECUTIA LIFE

These terms are between you and:

EXECUTIA LIFE is a product of EXECUTIA AS, available at https://life.executia.io.

Acceptance of terms

By accessing or using this website or EXECUTIA LIFE, you agree to these Terms of Service. If you do not agree, do not use the website or LIFE.

Nature and scope of LIFE

EXECUTIA LIFE is a software service for business and financial execution, including processing information relating to customers, invoices, money, documents and actions, subject to the features available in the user’s account.

LIFE may also display account, balance and transaction information obtained through Open Banking Account Information Services after you give consent, as described below.

LIFE is not a bank, credit institution, payment institution, or payment account. EXECUTIA AS does not hold your funds. LIFE does not provide payment initiation (PIS) functionality and does not execute bank transfers.

EXECUTIA AS is not a licensed Account Information Service Provider (AISP). Open Banking account-information access used by LIFE is provided through Enable Banking’s AIS infrastructure, as described below.

Content on executia.io and in LIFE does not constitute legal, financial, tax, investment, procurement, compliance or other professional advice. You remain responsible for your own business decisions and legal obligations.

Website

executia.io is an informational and product-development website. It presents EXECUTIA materials and channels for contact or pilot dialogue. Information, demonstrations and other materials may describe functionality that is being developed, tested or evaluated. Nothing on this website guarantees that a particular function is commercially available unless expressly stated otherwise.

Open Banking consent

If you connect a payment account to LIFE, you will be asked to give Open Banking / AIS consent at your bank (or other account-servicing payment service provider). Account, balance and transaction data is obtained only after that consent.

You decide whether to grant, refuse or later withdraw that consent. LIFE will not retrieve AIS account information without it.

Enable Banking’s role as AIS infrastructure provider

Enable Banking (Enable Banking Oy) is the regulated Open Banking / Account Information Services infrastructure provider used by EXECUTIA LIFE. Enable Banking is a registered Account Information Service Provider (AISP) supervised by the Finnish Financial Supervisory Authority (FIN-FSA).

Enable Banking provides the AIS connection between your bank and LIFE after you consent. Your use of that connection is also subject to Enable Banking’s terms and the terms of your bank. EXECUTIA AS uses Enable Banking as AIS infrastructure. EXECUTIA AS is not a licensed Account Information Service Provider (AISP).

Enable Banking may offer payment initiation infrastructure to licensed parties. EXECUTIA LIFE does not use payment initiation / PIS functionality.

User authorisation and responsibilities

You must be authorised to use the website and LIFE, and to grant any bank consent you give. You are responsible for:

• the accuracy of information you submit;
• keeping account credentials confidential;
• actions taken in your LIFE workspace;
• ensuring you have authority to connect any payment account you connect;
• your own tax, accounting, reporting and other legal obligations; and
• not using the services unlawfully or in a way that disrupts, damages or impairs their operation or security.

You must not attempt unauthorised access to systems, accounts or data, misrepresent your identity or affiliation, or use the services for unlawful, deceptive or harmful purposes.

Data freshness, availability and accuracy limitations

Account, balance and transaction information shown in LIFE depends on data supplied by your bank and by Enable Banking, and on whether a valid AIS consent exists. That information may be delayed, incomplete, temporarily unavailable, or different from the current position at your bank.

LIFE does not warrant that displayed balances or transactions are real-time, complete or free from error. Observed or historical figures are not a guarantee of current available funds. You should not treat LIFE as the authoritative source of bank truth where the underlying source is missing, stale or unverified.

Other LIFE data (for example invoices, documents or accounting connections) is likewise limited to what has been provided, imported or authorised, and may be incomplete.

Consent withdrawal

You may withdraw Open Banking / AIS consent at any time by disconnecting or revoking the bank connection in LIFE where that control is available, by using https://enablebanking.com/data-sharing-consents/, by using any mechanism your bank provides, or by contacting contact@executia.io.

After withdrawal, LIFE will not retrieve new AIS account, balance or transaction data under that consent. Withdrawal does not affect processing that was lawful before withdrawal. Further detail is in the Privacy Policy.

Service availability

We may update, suspend or discontinue parts of the website or LIFE at any time. We do not guarantee uninterrupted availability, error-free operation, or that all materials or features will remain available in their current form. AIS features also depend on Enable Banking and on your bank, which EXECUTIA AS does not control.

Termination

You may stop using the website or LIFE at any time and may request account deletion through contact@executia.io or the channels on our Contact page.

EXECUTIA AS may suspend or terminate access where reasonably necessary to protect the service, comply with law, address a breach of these terms, or discontinue a product or feature. Upon termination, AIS retrieval under your consents will stop. Retention and deletion of personal data are described in the Privacy Policy.

Intellectual property

The EXECUTIA name, branding, text, visual design, diagrams, documentation and software materials are owned by EXECUTIA AS or used under licence. You may not copy, modify, distribute, publicly display, or create derivative works from these materials except as expressly permitted by law or with prior written permission from EXECUTIA AS.

Pilot and collaboration requests

Submitting a pilot, contact or collaboration request does not create a binding contract, engagement or commitment unless and until agreed separately in writing. EXECUTIA may accept, decline or propose alternative next steps at its discretion.

Third-party services

The website and LIFE may reference or rely on third-party sites or services, including Enable Banking and your bank. EXECUTIA AS is not responsible for third-party content, policies or practices. Accessing third-party resources is at your own risk.

Disclaimer of warranties

To the fullest extent permitted by applicable law, the website, LIFE and related materials are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

Limitation of liability

To the fullest extent permitted by applicable law, EXECUTIA AS shall not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or business opportunities, arising from or related to use of the website or LIFE, including reliance on AIS account, balance or transaction information.

Nothing in these terms excludes liability that cannot be excluded under Norwegian law, including liability for wilful misconduct or, where mandatory, for death or personal injury caused by negligence.

Applicable Norwegian law

These Terms of Service are governed by the laws of Norway. Any dispute arising out of or relating to these terms, the website or EXECUTIA LIFE shall be subject to the courts of Norway, unless mandatory consumer protections provide otherwise.

Changes to terms

We may revise these Terms of Service from time to time. The “Last updated” date will be revised when changes are published. Continued use of the website or LIFE after changes become effective constitutes acceptance of the updated terms.
